Who should you appoint to be your attorney?

The most important decision to make when preparing your Power of Attorney is who to appoint as your attorney.

Because your attorney will be able to do anything you can do with your property and finances, your attorney should be someone you trust implicitly.

You also have the option of appointing more than one person to be your attorney to act as a ‘check and balance’ if you aren’t comfortable with only one person acting alone. If you nominate more than one person, you will need to nominate whether your attorneys are to make decisions jointly or individually.

It is also wise to nominate a back-up attorney to act in the event that your first preference is unable or unwilling to carry out their appointment.
